Welcome to Guilt Bites. By downloading, installing, or using the Guilt Bites application ("the app", "our service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, do not use the app.
[1] SERVICE DESCRIPTION
Guilt Bites is an AI-powered diet companion application that provides:
- AI-based food photo analysis with calorie and macronutrient estimates
- Interactive AI chat companion with adjustable sarcasm levels
- Food diary and calorie tracking
- Weekly AI-generated reports on eating habits
- Trend analysis and dietary insights
- Temptation resistance tracking
- Barcode scanning and voice logging
- Apple Health integration

It is NOT a medical device, NOT a certified nutritional tool, and NOT a substitute for professional medical advice, diagnosis, or treatment. All calorie estimates, health scores, and nutritional data are AI-generated approximations and may be inaccurate. Always consult a qualified healthcare professional before making significant dietary changes.
[2] ELIGIBILITY
- You must be at least 13 years old to use Guilt Bites.
- If you are between 13 and 18, you must have parental or guardian consent.
- By creating an account, you represent that you meet these requirements.
[3] USER ACCOUNTS
- You must provide accurate information when creating your account.
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activity that occurs under your account.
- You may delete your account at any time through the app's Settings.
- We reserve the right to suspend or terminate accounts that violate these Terms.
[4] SUBSCRIPTIONS & PAYMENTS
Free Tier:
- 3 AI food analyses per day
- 7-day food history
- Basic chat functionality
Pro Tier ($4.99/month or equivalent local pricing):
- Unlimited AI food analyses
- Full food history access
- Weekly AI reports
- Advanced trends and insights
- Voice logging and barcode scanning
- Apple Health integration
- Priority AI model access
- Subscriptions are managed through Apple's App Store.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
- You can manage and cancel subscriptions in your device's Settings > Apple ID > Subscriptions.
- Refunds are subject to Apple's refund policy.
[5] ACCEPTABLE USE
You agree NOT to:
- Use the app for any illegal purpose
- Upload inappropriate, offensive, or illegal content
- Attempt to reverse-engineer, hack, or exploit the app or its AI services
- Use the app to harass, abuse, or harm others
- Create multiple accounts to circumvent free tier limits
- Resell, redistribute, or commercially exploit the app's content or AI outputs
- Use automated tools to access the app's services
[6] INTELLECTUAL PROPERTY
- The Guilt Bites app, including its design, code, AI prompts, and branding, is our intellectual property.
- You retain ownership of photos you upload. By uploading, you grant us a limited license to process them for AI analysis.
- AI-generated commentary, health scores, and reports are provided as part of the service and may not be commercially redistributed.
[7] AI-GENERATED CONTENT
- All calorie estimates, macronutrient values, and health scores are AI-generated approximations.
- The AI companion's personality (including sarcasm and humor) is designed for entertainment. Its comments should not be taken as professional dietary guidance.
- AI responses may occasionally be inaccurate, inappropriate, or inconsistent.
- We do not guarantee the accuracy of any AI-generated nutritional information.
[8] LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law:
- The app is provided "as is" without warranties of any kind, express or implied.
- We are not liable for any health outcomes resulting from reliance on the app's AI estimates.
- We are not liable for any inaccurate calorie, macronutrient, or health score estimates.
- We are not liable for any data loss or service interruptions.
- Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.
[9] INDEMNIFICATION
You agree to indemnify and hold harmless Guilt Bites and its affiliates from any claims, damages, or expenses arising from your use of the app or violation of these Terms.
[10] TERMINATION
- You may stop using the app and delete your account at any time.
- We may suspend or terminate your access if you violate these Terms.
- Upon termination, your right to use the app ceases immediately.
- Sections regarding limitation of liability and indemnification survive termination.
[11] CHANGES TO THESE TERMS
We may update these Terms from time to time. We will notify you of material changes through the app or by email. Continued use of the app after changes constitutes acceptance of the updated Terms.
[12] GOVERNING LAW
These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes shall be resolved in the courts of Malaysia.
